MINUTES

Call Meeting To Order: Chair Sheedy called the meeting to order at 7:00 PM

Commission members present: Chair Sheedy, Commissioner Wagner, Commissioner Robb, Commissioner Magray, Commissioner Zastrow, and Commissioner Thomson. Commissioner Salemi, absent.

Staff present: Steve Dunks, Zoning Administrator; Graham Callis, Community Development Director, and Abby Villars, Deputy Clerk.

Approve Agenda

Motion was made by Commissioner Thomson to approve the agenda; second by Commissioner Zastrow.

Motion carried 6-0

Consent agenda

a. Approve the Minutes of the Wednesday, May 14, 2008, Planning & Zoning Commission Meeting

Motion was made by Commissioner Magray to approve the minutes; second by Commissioner Robb.

Motion carried 6-0

Public Forum (non-agenda items): Anything, which may be brought before the Plan Commission, for which no referral shall be made or action shall be taken.

Discussion/Recommendation: Request by James Diederich, Comfort Pro’s Insulators, to rezone parcel SU-197-3 from PCD to HWY Business. Located on the north side of Golden Arrow Road at US HWY 41.

STAFF:

This parcel is located on Golden Arrow Road west of Velp Avenue.

In April of 1996 the then Town Board approved a rezone request from Exclusive Agriculture to Planned Commercial District.

Other than an approved site plan, staff cannot locate any documentation that discusses the terms and conditions, or permitted uses of the PCD.

Environmental concerns for the site include a small stream that runs through the southeast corner of the parcel.

The parcel currently holds two metal pole buildings and a gravel parking lot.

HB with a PCD overlay is an appropriate zoning for this highway corridor parcel. The parcel is too small for the large impact permitted uses listed under HB, and any permanent outdoor sales or displays would go through site plan or conditional use approval.

Based on the findings of fact, staff recommends the rezoning request from Planned Commercial District to Highway Business with a Planned Commercial District overlay, made by James Diederich for the parcel SU-197-3 be approved.

Motion was made by Commissioner Zastrow to recommend approval for the rezone request for the portion of parcel SU-197-3 from Planned Commercial District to Highway Business with a Planned Commercial District overlay to the Village Board for public hearing; second by Commissioner Magray.

Discussion/Recommendation: Conditional use request by Lamers Bus to locate a 100 foot radio tower at 1934 Cardinal Lane. Located on the east side of Cardinal Lane, north of Garden Lane. Parcel SU-758-12, zoned Public Lands & Institutions.

STAFF:

Lamers Bus uses a tower to communicate with their buses in the Villages of Suamico and Howard. This is only used for the Howard-Suamico School District.

It is a 100 foot tower and is identical to the one that exists at the current site on the end of Waterway Court.

This is a site-based tower.

This is not a tower designed to handle multiple users and would most likely not have the height to be of any use to other possible tenants.

There will not be any equipment located around the base that will require screening or fencing.

The antenna will have a set-back from a residential structure greater than the required 100 feet.

PUBLIC:

Mike Schoemmer, (lives directly north of the site, no address was given) –

Resident questioned the board and staff on whether there would be any interference with anyone’s TV reception.

Staff reported that there shouldn’t be any impact with the digital coming into place. The reason they are doing this is that they are opening up the airways because they are getting too congested at the frequencies of what there is now for TV.

Motion was made by Commissioner Wagner to recommend approval of a conditional use for a 100 foot radio tower for Lamers Bus, parcel SU-758-12 located at 1934 Cardinal Lane, subject to the following conditions:

1. Meet the requirements of all other applicable ordinances, regulations and reviewing agencies.

2. Any additional antenna and/or users shall require additional approval as a telecommunications tower.

Second by Commissioner Thomson

Motion carried 6-0

Discussion/Recommendation: Recommended changes to 18.22, Planned Development Districts, 18.04(16) Parking Standards, and 18.18 Off-Street Parking.

Staff and the commission went over the parking setbacks in the Planned Commercial Development and standard developments.

The other changes to Chapter 18 that were presented to the Planning Board are to the language to make it easier for the public, architects and builders to follow the requirements on their site plans.

Motion was made Commissioner Zastrow to forward the recommended changes to the Village Board with the change under 18.18 paragraph 2 size to be amended to 9 feet in width and 18 feet in length; 2(A), and also to recommend the staff report to include under 1(B) that the parking facilities shall be provided for such that in order to allow an expansion that the parking lot for the original structure be brought up to minimum standards; second by Commissioner Robb
